Kampala Capital City Authority {KCCA} is free to take over Management of taxi parks in the city unless taxi operators’ association (UTODA) runs back to court to properly file its earlier case against the Authority that has now been dismissed.
Justice Eldard Mwangushya of the High court dismissed the case this afternoon and ordered UTODA pay costs to KCCA for dragging it to court using the wrong procedure.
UTODA petitioned court seeking a judicial review over KCCA’s decision to take over management of New and Old Taxi Parks but Justice Mwangushya ruled that this is a case beyond just revision saying what is supposed to be determined are UTODA’s rights over the alleged expired contract.
KCCA lawyers led by Charles Ouma last week asked the court to throw out UTODA’s case saying that it could only be brought to court by way of an ordinary suit to establish the validity of UTODA’s contract.
The lawyers also say the interim order granted to UTODA in Oct last year restraining KCCA from taking over management of city taxi parks has now expired, but UTODA lawyers, Moses Kabega and Musa Ssekaana did not turn up in court today and information on whether they will be going back to court could not be established.
The court battle stems from a memo written by the Kampala Executive Director, Jennifer Musisi dated June 7, 2011, in which she said UTODA’s contract was expiring on October 31 last year and subsequently revealed that KCCA would start managing the taxi parks and collecting revenue from them on November 1st Last year but UTODA went to court to seek redress.
